An occupation order aims to monitor/restrict the occupation of a family home.
Sometimes, this is used to exclude someone from the family home, but it can have other purposes too. This includes:
Enforcing the right to remain in the property
Regulating the occupation of the property
Prohibit/suspend/restrict the exercise of occupation in the property
Require the departure of someone from the property
Excluding someone from a defined area that the property is located in
An occupation order is related to The Family Law Act 1996, which aims to protect sufferers of domestic abuse.
Under The Family Law Act, a victim of abuse can apply for a Non-Molestation Order, which prevents the perpetrator from pestering, molesting or harassing the victim. This, however, doesn’t cover the issue of the perpetrator accessing the family home.
That’s where an Occupation Order comes in. This regulates who can live in the family home. These orders are only granted in serious circumstances, as they can effectively ban someone from living in a home that they are legally entitled to live in (i.e. if the perpetrator owns or jointly owns the property).
